How to file form 8809 to request an extension for 1099-NEC/W-2 forms?

Key Instructions:

  • The IRS requires paper filing of 8809 to request an extension for these forms. Once you complete the form, we will postal mail it to the IRS.

  • For 1099-NEC and W-2, you can submit an extension request only if you meet specific criteria outlined by the IRS.

    • The filer suffered a catastrophic event in a federally declared disaster area that made the filer unable to resume operations or made necessary records unavailable.

    • Fire, casualty, or natural disaster affected the operation of the filer.

    • Death, serious illness, or unavoidable absence of the individual responsible for filing the information returns affected the operation of the filer.

    • The filer was in the first year of establishment.

    • The filer did not receive data on a payee statement, such as Schedule K-1, Form 1042-S, or the statement of sick pay required under section 31.6051-3(a)(1), in time to prepare an accurate information return.

 

To e-file your Form 8809 with TaxBandits, follow these steps for a hassle-free filing experience:
 

Step 1: Sign in to your TaxBandits account.

Step 2: From the dashboard, click 'Start New Form' and select '8809.'


 

Step 3: If you want to file an extension for 1099-NEC and W-2 forms, click the ‘Request a Filing Extension for 1099-NEC, W-2, 1099-QA or 5498-SA’ button. 
 


 

Step 4: Click on 'Add New Payer/Filer' to add the details. If you have already added the payer details, click 'Select Payer/Filer From Address Book.'


 

Step 5:  Select the type of form for which you are requesting an extension. You can check a single or multiple forms and then select the reason for the extension. 
 


 

Step 6: Preview the form, e-sign it, proceed to payment, and transmit the form. We will postal mail your extension form to the IRS.

 

Note:

  • The IRS correspondence will be sent to the mailing address you've provided.
  • Once accepted, you'll be granted a 30-day extension to file your 1099-NEC or W-2 form with the IRS.
  • Form 8809 only extends the filing deadline. If you need to extend the recipient copy deadline for these forms, you must file 15397.
